For Sale by Owner

When selling a home, legally you must state everything that is wrong with it. I find the following is not often revealed.

  1. Before you allow a foreclosure, ask three magic words of your lender ...

    PRODUCE THE NOTE

    You have a legal right to have a copy of your deed with a lien attached to it and see it along with the supporting documents.
    Many homeowners are now insisting on this.
    If the mortgage company refuses go to your local court house, you don't need a lawyer, and file a document to get one.
    Because these banks and mortgage companies package mortgages in bundles and sold them and then they were resold over and over again, the paperwork may not be there and without it they cannot foreclose.
    This tactic is working in many states and judges are telling mortgage companies produce the paperwork or don't foreclose.
    This is NOT an out for you the borrower, you the owe the mortgage and they will eventually catch up to you but it may buy you the time you need.

  5. On the day that the Obama administration begins implementing a new program to fight home foreclosures, a new national poll suggests that most Americans think the plan is unfair to those who pay their mortgages on time.

    Sixty-four percent of those questioned feel the Obama administration program is unfair to those who pay their mortgages on time. Only 28 percent say that the president's $75 billion plan is fair. More details on the program, which is aimed at helping up to nine million borrowers stay in their homes using refinanced mortgages or modified loans, were released Wednesday.

  11. Many realtors are ethical and easy going honest people. Sounds like you tried and couldn,t and are mad about it. Maybe you need to be honest with yourself, and just get a life and let go of the hurt and resentment and move on. I know this will not make it to "your site". Just thought I'd get to the truth with.....YOU!!!!

  13. Without a Realtor many buyers would be facing foreclosure just a few short years down the road. They would not have the $20k + needed to fix a home that has cracked in half and is falling away at both sides. but because they used a Realtor, they are in a nice home where they can raise their family because they got a home inspection at the assistance of their realtor. They $3000 in commission that was paid in the transaction was much less than the costs incurred with losing their first dream home.many more great scenarios like these. What about the one where the Realtor tells the buyer about a grant that reduced his mortgage note by $39000 at closing? That's a good one too.

  14. As a Realtor, I would like to tell everyone here that I am sorry on behalf of all good Realtors everywhere. Obviously, you've all had a really unpleasant experience with someone in our industry, and had expectations that were not met. There are many of us out there who genuinely care and want the best for our clients, and it hurts us to hear these stories. If anything good has come from this current situation, it is that many less-than-professional agents have been "weeded out," if you will. I hope that all of you have the best of luck and great experiences in the future, whether you are buying or selling your homes. :)
